Terms of Use

Version 2 · Updated

About these terms

HeroWOD.com (the "site") is run by HeroWOD.com ("we," "us" and "our"). These Terms of Use are an agreement between you and us. They apply whenever you use the site, whether you're browsing or signed in to an account.

These terms include, as sections below:

Two other documents are also part of these terms: the Privacy Policy and the Exercise Liability Waiver and Assumption of Risk.

By creating an account, you confirm that you've read and accepted these terms and those documents. If you don't agree, please don't create an account.

Who can use HeroWOD

Anyone, anywhere, can browse the site without an account.

Only people with a US phone number can create an account. Numbers from US territories (Puerto Rico, Guam, the U.S. Virgin Islands, American Samoa and the Northern Mariana Islands) are accepted. Numbers from other countries, toll-free numbers and premium-rate numbers are not.

To create an account you must also be 18 or older and have an email address you can use.

Each account is for one person. Keep your phone number and email current, because we use them to sign you in and to recover your account.

What HeroWOD is

HeroWOD honors first responders and military members who died in the line of duty through Hero WODs: workouts named for them. Every workout page leads with the hero's story, then the workout.

With an account, you can mark workouts complete and keep a personal history, see your results against everyone's anonymous results, join groups, comment, report content that breaks our rules, and submit heroes and workouts for us to consider.

There is no public leaderboard. Your actual results are visible only to you and to the groups you share them with (see the Privacy Policy).

Signing in and keeping your account safe

HeroWOD doesn't use passwords. You sign in with a one-time code sent by text, a link sent by email, or a passkey you've set up on your device. Staff sign in with both a code and a link, or with a passkey.

You're responsible for what happens in your account. Keep your phone, email and devices secure, and don't share codes or links we send you. You can see where you're signed in, and sign out of other sessions, in your account settings. If you think someone else has used your account, tell us at support@herowod.com.

Your results

When you mark a workout complete, the date is the day you mark it, in your time zone. You can change or delete a result for 24 hours. After that it's locked, and nobody, staff included, can change it.

Your results count anonymously in each workout's statistics. Statistics are for interest and motivation only.

Content you post

You own what you post: comments, your display name, photo and bio, group names, icons and descriptions, and workout submissions.

So that we can run the site, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, display, format and share that content on the site and in the messages it sends, for as long as it's on the site and for a limited time afterward in backups.

Workout submissions go further. If we approve a submission, you also let us edit it, combine it with other information, publish it as part of a hero or workout page, and keep publishing it after you delete your account. We don't credit submitters publicly.

When you post or submit anything, you promise that you have the right to share it, including any photo, and that it follows our Community Guidelines.

Our content

Hero stories, photos, workout pages, statistics, the site's design and its code belong to us or to the people who licensed them to us. Photo credits are shown with each photo. You may read, share links to, and do the workouts on HeroWOD for your own non-commercial use. Don't copy the site's content in bulk or republish it without permission.

How we write hero stories, choose photos and handle requests from families is explained on our About us page.

Rules of conduct

Follow our Community Guidelines. In addition, don't:

  • break the law, or use the site to help anyone else break it
  • pretend to be someone else, including our staff or a hero
  • create an account, or change your phone number or email, to get around a suspension
  • try to get around our security, sign-in checks, CAPTCHA or rate limits
  • scrape, crawl or copy the site with automated tools, except search engines following our robots rules
  • interfere with the site, overload it, or probe it for weaknesses
  • misuse reports, appeals or family removal requests

Community guidelines

HeroWOD exists to honor first responders and military members who died in the line of duty. Their families, friends and fellow service members may read what's posted here. Everything members share, in comments, profiles and groups, should reflect that respect. Anyone can browse the site, but only members can post.

Honor the heroes

  • Speak about every hero, their family and their service with respect.
  • Don't mock a hero, speculate about how they died, or use a hero's page to argue about politics, policy or the conflict they served in.
  • Don't post information about a hero that you know is false. If you think a story has a mistake, tell us at support@herowod.com instead of arguing about it in the comments.

Respect each other

Don't post anything that:

  • harasses, bullies, threatens or intimidates anyone
  • attacks people for their race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age or veteran status
  • is sexually explicit, or shows graphic violence or injury
  • shares someone else's private information, such as a phone number, address or email
  • pretends to be someone else, including our staff, a hero or a hero's family
  • is spam, advertising, or links posted to promote a business
  • breaks the law, encourages someone else to, or infringes someone's copyright or other rights
  • encourages dangerous training, such as pushing through injury or skipping medical care

Comments

  • Comments are plain text, up to 1,000 characters, and are seen only by signed-in members.
  • You can delete your own comments, but you can't edit them. A comment you delete disappears for other members, but our staff can still see it until your account is deleted.
  • To prevent spam, how often you can comment is limited.

Profiles

  • Display names are 2 to 30 characters, and you can change yours once every 24 hours.
  • Display names can't contain profanity, can't suggest you're part of our staff (for example "admin," "owner," "staff," "moderator," "support" or "HeroWOD"), and can't be the same as a hero's name.
  • Your photo and your bio, up to 280 characters, follow these guidelines too.

Groups

  • Group names, icons and descriptions follow these guidelines.
  • Group owners and admins decide who joins and can remove members. They're members like you, not our staff.
  • Group results are shared only as each member's settings and the group's settings allow. Don't share other members' results outside the group.

Workout submissions

  • Submit heroes and workouts in good faith, with accurate information and at least one source.
  • Only upload a photo you have the right to share, and credit it properly.
  • Our staff review every submission and may edit it. Submitters aren't credited publicly.

Reporting

If you see a comment, profile or group that breaks these guidelines, report it. Reports are a short note of up to 500 characters. You can report each item once, and you can't report your own content.

We review reports, but we don't tell the person who reported or the person reported what we did. A comment reported by 3 different members is hidden until our staff review it. Profiles and groups stay visible until staff act.

Please don't file reports to harass someone or to settle a disagreement.

Moderation, suspensions and appeals

When something breaks these guidelines or these terms, our staff can:

  • hide, restore or delete a comment
  • rename a profile, remove its photo or clear its bio
  • rename a group, remove its icon, edit its description or delete it
  • suspend an account

A suspension lasts until we lift it. We'll email you when your account is suspended, but we don't share the reason. While suspended you can still sign in, see content and delete your account. You can't post, comment, mark workouts complete, create groups, change anything public on your profile, submit workouts or report content. Your profile and comments are hidden from other people.

You can appeal a suspension from the notice shown in your account. You can have one appeal pending at a time, and after a denial you can appeal again 7 days later. If an appeal is approved, the suspension is lifted.

When we suspend an account, we keep keyed fingerprints (hashes) of its phone number and email. A new account, or a phone or email change, that matches them is suspended automatically. Lifting the suspension removes them.

Every staff action is recorded in our staff activity log.

We respect copyright and expect our members to do the same. We respond to notices of claimed infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and we end the accounts of repeat infringers in appropriate circumstances.

Photos and stories on hero pages

Hero photos are shown with a credit. If you hold the rights to a photo or text on the site and want it credited differently or taken down, contact us at support@herowod.com and we'll work with you, or send a formal notice as described below.

If you're a hero's family member and want their page removed, see our About us page. That's a separate process and doesn't need a copyright notice.

Sending a copyright notice

Send DMCA removal requests to support@herowod.com.

Your request must include:

  1. your physical or electronic signature, as the copyright owner or someone authorized to act for them
  2. a description of the copyrighted work you believe was infringed
  3. a description of the material you believe infringes it, and where it is on the site, such as its web address
  4. your name, mailing address, phone number and email address
  5. a statement that you believe in good faith that the use isn't authorized by the copyright owner, its agent or the law
  6. a statement that the information in your notice is accurate and, under penalty of perjury, that you're the copyright owner or authorized to act for them

Notices that leave out these details may not be acted on.

When we receive a valid notice, we remove the material or disable access to it promptly. If a member posted it, we tell them it was removed and send them a copy of the notice.

Counter-notices

If you believe material you posted was removed by mistake or misidentified, you can send our designated agent a counter-notice that includes:

  1. your physical or electronic signature
  2. a description of the material that was removed and where it appeared before it was removed
  3. a statement, under penalty of perjury, that you believe in good faith the material was removed by mistake or misidentification
  4. your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is, and that you'll accept service of process from the person who sent the original notice or their agent

When we receive a valid counter-notice, we send a copy to the person who sent the original notice. We restore the material 10 to 14 business days later, unless they tell us they've gone to court to stop it.

Repeat infringers

We end the accounts of members who repeatedly infringe copyright, in appropriate circumstances.

False claims

Under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. If you're not sure whether something infringes your rights, consider talking with a lawyer first.

Supporter subscription

This section applies if you subscribe. Supporters help keep HeroWOD running. As a Supporter you get:

  • a Supporter tag next to your name wherever it appears on the site
  • membership in up to 10 groups, instead of 3

Price and payment

The subscription costs $29 per year, in US dollars. We don't add sales tax.

Stripe processes payments for us, and Stripe's own terms and privacy policy apply to the payment details you give it. We never receive your full card number. You can add, remove and choose a default payment method in the billing section of your account settings.

Automatic renewal

Your subscription renews automatically every year on the anniversary of the day you subscribed, and we charge your default payment method the annual price at that time. It keeps renewing until you turn off auto-renew.

Your renewal date and next charge are always shown in the billing section of your account settings. If the price changes, the new price applies only from a renewal after we've told you about the change.

Turning off auto-renew

You can turn off auto-renew at any time in the billing section of your account settings. You stay a Supporter until the end of the year you've paid for, and then the subscription ends. Until then, you can turn auto-renew back on.

Turning off auto-renew doesn't refund the current year (see "Refunds" below).

Failed payments

If a renewal payment fails, you have a 3-day grace period to update your payment method, and you stay a Supporter during it. After the grace period, your Supporter status is removed until a payment succeeds. We'll email you if a payment fails and when the grace period ends.

Refunds

Refunds are decided case by case. To ask for one, email support@herowod.com.

  • A full refund cancels your subscription and ends your Supporter status immediately.
  • A partial refund doesn't change your subscription or your Supporter status.

Receipts

We email you a receipt for each payment. Your payment history in the billing section of your account settings links to the receipts and invoices Stripe keeps for you.

Free Supporter status

We may give someone Supporter status free of charge. Free Supporter status doesn't expire, but we may end it.

If your Supporter status ends

When your status ends, you keep all your group memberships, but if you're in more than 3 groups, you can't join or create another group until you're in fewer than 3.

If you delete your account

Deleting your account cancels your subscription immediately and ends your Supporter status. Refunds are still decided case by case.

Messages we send

We send texts and emails to sign you in and to tell you about your account, such as a passkey added, a suspension, an appeal decision, a submission decision or a billing event. You can't turn these off while you have an account.

Weekly featured-workout and group join-request notifications are optional, and you choose them in your settings. Our SMS terms cover every text we send.

SMS terms

We text from two separate numbers:

  • a sign-in number, which sends only sign-in codes
  • a notifications number, which sends only the optional notifications you turn on

Keeping them separate means that stopping notifications never stops your sign-in codes. Our Privacy Policy explains how we handle your phone number.

Sign-in codes

When you sign up, sign in with your phone, recover your account or confirm it's you, we text a one-time 6-digit code from the sign-in number. Each code works for 10 minutes.

Sign-in codes are transactional messages: we send one only when a code is requested on the site, one message per request, and never anything else from that number. Because they're sent only on request, they don't carry opt-out instructions. To stop getting them, don't request codes: you can sign in with an email link or a passkey instead.

Text notifications

What we send

HeroWOD notifications are optional texts about:

  • the weekly featured workout, sent on Monday at 8:00 AM in your time zone
  • pending group join requests, sent to group owners and admins, summarizing the requests waiting for them

How you sign up

Text notifications are off until you turn them on. You turn each type on in the notifications section of your account settings, by ticking a box that confirms you agree to receive these texts at your number. We record your consent and when you gave it.

Agreeing to text notifications isn't a condition of creating an account, subscribing or using the site.

How often

Message frequency varies. The weekly featured workout is one text a week. Join-request texts go only to group owners and admins, at most one per group per hour while requests are waiting.

Cost

Message and data rates may apply, according to your mobile plan. We don't charge for texts.

Stopping notifications

Reply STOP to the notifications number at any time. We'll turn off all your text notifications, and you'll get one text confirming it. You can also turn them off in your account settings.

Replying START doesn't turn notifications back on. To get them again, turn them on in your account settings.

Getting help

Reply HELP to the notifications number for help, or email us at support@herowod.com.

Carriers

Carriers are not liable for delayed or undelivered messages.

Your mobile information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with any third parties.

Changing or giving up your number

If you change your phone number, update it in your account settings so our texts follow you. If you give up a number, change it on HeroWOD or delete your account first, so our texts don't reach whoever gets the number next.

Health and safety

Hero WODs can be hard and dangerous. Read the Exercise Liability Waiver and Assumption of Risk before you do any workout. Nothing on the site is medical advice.

Ending your account

You can delete your account at any time in your account settings, after confirming it's you. Deletion is permanent. The Privacy Policy explains what's deleted and what's kept without your name.

We may suspend or delete an account that breaks these terms, or when the law requires it.

Disclaimers

We work hard to tell each hero's story accurately, but stories are compiled from public sources and submissions and may contain mistakes. If you see one, please tell us at support@herowod.com.

The site is provided "as is" and "as available." To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose and non-infringement, and we don't promise the site will always be available or free of errors.

Limitation of liability

To the fullest extent the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of the site.

To the fullest extent the law allows, our total liability for any claim about the site or these terms is limited to the greater of the amount you paid us in the 12 months before the claim and US $50.

Some states don't allow some of these limits, so they may not all apply to you.

Indemnity

If someone brings a claim against us because of content you posted or your breach of these terms, you agree to cover our reasonable costs and losses from that claim, to the extent the law allows.

Governing law and disputes

These terms, including the Supporter subscription section, are governed by the laws of California and applicable US federal law, without regard to conflict-of-law rules. Any dispute about the site or these terms will be decided by the state or federal courts located in California, and you and we agree to those courts' jurisdiction.

Before bringing a claim, please contact us at support@herowod.com so we can try to resolve it informally.

Changes to these terms

Every legal document on HeroWOD is versioned, and each new version says what changed.

When a change needs your agreement, we'll ask you to review and accept it the next time you use the site while signed in. Until you do, you can still sign out, read the legal documents, download your data, delete your account and turn off Supporter auto-renewal, but nothing else. Small corrections that don't change your rights appear as a notice you can dismiss.

Other terms

These terms, with the Privacy Policy and the Exercise Liability Waiver, are the whole agreement between you and us about the site. If a court finds part of them unenforceable, the rest still applies. If we don't enforce a term right away, we haven't given it up. We may transfer these terms to a business that takes over running the site, such as a company formed to run HeroWOD. You may not transfer them.
